Iowa Appeals Court overturns kidnapping conviction
DAVENPORT, Iowa (AP) — A 37-year-old Davenport man has won a chance at a new kidnapping trial.
The Quad-City Times reports that James Salkil’s conviction was overturned Wednesday by the Iowa Appeals Court.
Salkil and two other men were accused of kidnapping and assaulting Anthony McFarland, of Davenport, in March 2010. Benjamin Border and Nathan Johnson pleaded guilty and were sentenced to 24 years in prison.
Salkil said in his appeal that the jury was improperly instructed on the kidnapping charge.
Salkil’s conviction for assault causing serious injury was not overturned. He’s expected to be retried on the kidnapping charge.
