Judge reviews victim records in frat brother case

DES MOINES, Iowa (AP) — A former Drake student sentenced last month to 20 years in prison for sexually assaulting a fraternity brother has convinced a judge to review his victim’s psychological records.

The Des Moines Register reports Anthony Bertolone’s attorney sought the records. Attorney Alfredo Parrish says Bertolone is entitled to see the records, which surfaced during sentencing last month.

Polk County prosecutors agreed Monday to present the records to District Judge Scott Rosenberg.

The records involve counseling sessions shortly after the victim reported his abuse to police in August 2010. At trial the victim described only two brief medical appointments during the time Bertolone molested him. Information surfaced at sentencing about additional psychological interventions.

Parrish says the failure to disclose the records should force a re-evaluation of the victim’s truthfulness.
